E ffective July 1, joint ownership forms will be required for any application for a title that has more than one owner listed on that title. When more than one owner is listed on a title all owners must complete and sign a form specifying if the vehicle is listed in Joint Tenancy or Tenants in Common. This form is being required by the Department of Revenue and before any title papers can be processed this form is to accompany the title work.

Joint Tenancy with rights of Survivorship is defined as: A form of legal co-ownership of property (also known as survivorship). At the death of one co-owner, the surviving co-owner becomes sole owner of the property. Transfer of ownership on a Colorado Certificate of Title requires a copy of a death certificate and signature of survivor.

Tenancy in Common is defined as: The equal or unequal holding of property by two or more persons. At the death of one co-owner, the deceased share of the property goes to his/her estate and is to be divided according to his/her will or the law in the absence of a will. Transfer of ownership on a Colorado Certificate of Title requires documents appointing a personal representative for the decedent.

Election Information

The Nov. 1 coordinated election will be conducted as an all mail-in ballot election for Logan County voters. All active eligible electors will automatically be mailed a ballot the week of Oct. 11-14. (No polling places for the Nov. 1 election will be available.)

If you have moved since the last election you might need to update your address with us so that you receive your ballot in the mail. Ballots are not forwardable so we need to have your current address information in order for you to receive your ballot.

All voted ballots and replacement ballots declarations must be returned to the Logan County Clerk and Recorder`s Office, 315 Main St., Suite 3, Sterling, CO 80751 before 7 p.m. Nov. 1.

Unity of possession: Each co-owner is entitled to possession of the whole of the land and none is entitled to any part of it to the exclusion of the other co-owners. (This is actually a characteristic of both joint tenants and tenants in common. For this reason, the respective interests of both kinds of co-owners are said to be “undivided.”) One of the key recommendations set out in the paper is to allow joint tenancies to be created without all four unities: only unity of possession would be required. Accordingly, if the recommendation were implemented, two owners could acquire property with one owner having say a 65% interest and the other a 35% interest, and hold title so that on the death of one, the survivor will hold the entire interest by right of survivorship. In British Columbia it is possible for one co-owner to sever a joint tenancy secretly, without the knowledge of the other co-owner or co-owners. If the joint tenancy is severed by one joint tenant, then he or she becomes a tenant in common and can leave his or her interest by will. The report contains a recommendation that to sever a joint tenancy (or co-ownership with survivorship) the severing owner must give notice to the other owner or owners.
